Swanson Midgley views dispute resolution in three ways. First, assisting the client in trying to settle a dispute without the delays and expense of litigation. Next, considering what is known as Alternative Dispute Resolution (“ADR”), which can facilitate resolving disputes more rapidly and generally less expensively than in the court system. Finally, as a last resort, we are frequently engaged in litigation in state and federal courts, where the right to an appeal is the ultimate assertion of our clients’ rights to resolve a dispute.
Our lawyers have substantial experience in arbitration and mediation, with some actually serving as mediators, who also practice in Kansas and Missouri courts, as well as in local federal courts. Depending on the matter at hand, we are careful to select the attorney in our litigation department who best fits the situation. We strive to be sure that we have the right lawyers to address the challenge and who meet the client’s expectations.
Areas of most frequent involvement by our litigators include creditors’ rights, ADR, commercial litigation, employment litigation, estate and fiduciary litigation, real estate, and construction litigation, workers compensation litigation, and insurance defense litigation.
