Employer Preparedness for the H1N1 Flu

The Equal Employment Opportunity Commission (EEOC) has released two pieces of guidance for employers related to a potential flu pandemic: ADA-Compliant Employer Preparedness For the H1N1 Flu Virus and Employment Discrimination and the 2009 H1N1 Flu Virus (Swine Flu). The guidance answers basic questions about workplace preparation strategies for the 2009 H1N1 virus that are compliant with the Americans with Disabilities Act (ADA), including an ADA compliant model survey of employees that could be issued to all employees in preparation for a pandemic. The EEOC guidance also reminds employers that the Swine Flu outbreak is not an excuse to discriminate against employees and potential employees on the basis of disability or national origin.
